Terms & Conditions
Welcome to G A L E K T I C A. 
Please read the Terms and Conditions set out below carefully before you start using the website www.galektica.com (the ‘Website’).  These Terms and Conditions govern all offers, orders, agreements and other legal relationships between you and GALEKTICA with respect to the use of the Website, including the purchase and sale of a product on or via the Website.
By using this Website you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions you may not use and access this Website. 
References in these Terms and Conditions to "we", "us" and "G A L E K T I C A" are to G A L E K T I C A, Roomeinde 9, 1151AL Broek in Waterland, The Netherlands. Registered at Chamber of Commerce Amsterdam: 34357751
Order process
All orders that you place on this Website will be subject to our acceptance. Acceptance of your order and the completion of the contract between you and G A L E K T I C A will only take place when your order is dispatched. We will send you a confirmation by e-mail once your order has been dispatched and thus accepted. We reserve the right to dispatch multiple orders separately. 

 

Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
1. The product you ordered is out of stock;
2. Our inability to obtain authorization for your payment or other reasons why your payment is not received within the agreed term in case we agreed on advance payment;
3. You have already failed to comply with your payment obligations towards us in the past;
4. You in the past have failed to accept and/or collect orders that you placed with us;
5. We have identified a pricing or product description error;
6. There is a system or procurement failure; and/or
7. Failed customer validation checks.
 
When you place an order on our Website we shall e-mail you an acknowledgment detailing the product(s) you have ordered. This e-mail is NOT an order acceptance from G A L E K T I C A.
Order Cancellation
If, for any reason, you wish to cancel any order you have placed before it has been delivered and it has not been dispatched, you can cancel the order yourself by sending an e-mail to info@galektica.com.
 
As it is our policy to try to process orders immediately it may not always be possible to stop an order from being dispatched. After dispatch our Returns Policy (see below) will apply.
Prices
The prices indicated on the Website are denominated in euros, are inclusive of Value Added Tax (VAT) (if applicable) and are exclusive of shipping costs. 
The shipping costs will be charged separately in respect of each agreement. For products to be delivered within Europe the shipping costs will amount €6-€9 depending on the size and country. For products to be delivered outside Europe the shipping costs will amount €9-€20 depending on size and country. 
Please do note that international shipments may be subject to customs duties and import taxes upon entry into the country of destination over which we are unaware. G A L E K T I C A cannot be held accountable for any of these customs duties and import taxes. You should contact your local authorities to take notice of these fees and the respective values that differ from country to country and over which we have no knowledge. 
The total purchase price due (including shipping costs and VAT, if applicable, but excluding customs duties and import taxes) will be indicated when the order is placed.  
We are entitled to adjust the prices indicated on the Website from time to time without any notice being required. The prices indicated at the time at which the order is placed will in principle be deemed to be the prices that form part of the agreement. 
Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled. 
Payment
Payment may be made using the methods indicated on the Website and must be made before the Product has been delivered. 
The following payment methods are accepted. 
Online banking
Pay by using direct online transfer from your bank account through Ideal.
Credit cards
Payment can be made by the following credit cards: Visa, Mastercard, and American Express. The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once you place the order
We will take all reasonable care, in so far as it is in our power to do so, to keep the Website and details of your purchase and payment secure, but, in the absence of negligence on our part, we will not be liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website. Our site uses industry standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address and credit card details. Furthermore, all credit/debit card transactions on the Website are processed using Shopify Payments, a secure online payment gateway that encrypts your card details in a secure host environment. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to G A L E K T I C A, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as a result of payment being processed in respect of your order. 
At checkout you can choose to save your credit card for future purchases if you are logged in to your G A L E K T I C A account. Your details will be protected using Global Sign Encryption and will speed up your order process the next time you shop on our Website.
You are obliged to notify us immediately regarding any errors in the payment details that you have provided to us.
In the event that you exceed the term for payment, you will be in default by operation of law, and we will be entitled to charge statutory interest on the outstanding amount as from the due date.
Product availability and information
We feature products on our Website that have been carefully selected for sale by G A L E K T I C A. Once an item is sold out it will be taken off the Website at the earliest opportunity and may not be available again. Products are subject to availability. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out-of-stock items.
We will take all reasonable care to ensure that all details, prices, photographic representations and descriptions of products appearing on the website are correct at the time when the relevant information was entered into the system. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our products that appear on the website. What you see will however depend on your monitor and computer equipment. We are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise. Please refer to our Return Policy (as indicated below) if you are unhappy with your purchase.
Delivery method and delivery dates
Shipment will be made using a carrier designated by G A L E K T I C A. Our preferred carriers are Post NL and DHL. 
After the order has been received we will deliver the product(s) as soon as possible, and in any event within fourteen (14) days, to the address indicated by you, provided that the shipping address is in the EU and we have received the full purchase price if you have chosen for advance payment. A longer delivery period of up to one month may apply, if the shipping address is outside the EU or if parties agreed on a longer delivery period, for example in the case of made-to-order products. When placing your order please ensure that the billing and shipping address details are correct, as we are unable to redirect. When your order is shipped, we will send you a confirmatory email. As indicated above, this confirmation also accounts as acceptance of your order.
During the sale and holiday periods, longer delivery times may apply.
We will make every effort to deliver the product(s) within the above estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example extreme weather, a flood or fire. Also, we cannot be responsible for delays as a result of remote delivery locations. In addition, you acknowledges that the delivery dates are based on the circumstances of which we are aware at the time at which the agreement is concluded and, insofar as they are dependent on work or services to be provided by third parties, on the information that such third parties provide to us. We shall be under no liability for any delay or failure to deliver the products within the estimated timescales. 
All products will be delivered by carrier and will require a signature on delivery. If you are out when the carrier attempts to deliver your order, they will leave a card with a contact number for you to arrange a new delivery date. Please be aware that our service is not a named delivery service and anyone at the designated delivery address may sign for your delivery. We will not be liable for a lost or missing order that has been signed for in a building, for example an office address that has been provided for delivery. The risk with respect to any damage to or loss of the products will be transferred to you as from the first time at which the carrier attempts to deliver the product(s) to you.
Return Policy
G A L E K T I C A has a 14-day return policy: you have 14 days from when your order is delivered to ship it back to us for a refund. You will not be permitted to exchange the product for another product. If you wish to purchase another product you will have to place a new order on the Website.
Any claim regarding the return of product(s) must be submitted in 14 days following receipt of the product(s). You must contact the G A L E K T I C A beforehand to obtain a “Return Authorization”. You can use this model form in order to obtain such Return Authorisation or simply send us an e-mail (info@gelaktica.com). Once you have received the Return Authorization, you can return the product(s) back to us.  Take your parcel to the Post Office within seven days of the return being authorised. Please make sure that you obtain proof of posting as we will not be held responsible for any lost or damaged products. 
Products must be returned in their original condition with all tags attached in the branded packaging provided. This is also to ensure that item(s) arrives back to us in a suitable and undamaged state. All accessories must be returned with the original branded boxes and dust bags, where provided, and placed inside a protective outer box for shipping. Please take care when trying on your purchases and return them in the same condition you received them. Returns that have been worn, used, altered or damaged will not be accepted and may be sent back to you and/or a refund may be refused or a refund may be paid out after deducting any damages. Any parcel returned after the prescribed timeframe shall be refused. 
The costs and risks pertaining to the return of product(s) are borne by you. G A L E K T I C A is not responsible for the refund any import tax/duty that your order may have incurred for returned items. G A L E K T I C A cannot be held responsible in the event of loss, theft or damage of the returned parcel. Returned parcels for which your identification (surname, first name, address and return code) is not possible shall be refused. No parcel returned as cash on delivery shipping shall be accepted, whatever the reason.

Complaints procedure
Please contact us if you have any comments or complaints. Quality issues are our responsibility, within the limit of 2 years following the date of purchase upon presentation of the proof of purchase. 
Please note that you are obliged to inspect the product when it has been delivered and to notify us immediately in the event that there are any visible defects or other complaints regarding the performance of the agreement. Such complaints must be submitted in writing to info@galektica.com and must be fully and clearly substantiated.
We will respond to any complaints that we receive within a term of 14 days after receipt. We will notify you within a term of 14 days in the event that it is foreseeable that the complaint will require a longer-term to be processed, stating the term within which you can expect to receive an answer.   
You acknowledge that minor deviations, deviations that are generally considered acceptable and deviations that cannot be avoided or that are difficult to avoid in respect of the quality, size, colour, finishing, etc. of the products do not constitute a well-founded reason to submit a complaint. The same applies for damages as a result of daily wear: darkening, snags, marks, stains, scratches, normal wear, etc. 

Such complaints, complaints regarding the fact that certain articles or spare parts have been taken out of the product range and complaints after the product has already been repaired by a company other than GALEKTICA are not well-founded. We will not be liable for any damage that you sustain as a result of such complaints. For the costs and risks pertaining to the return of damaged product(s), our Return Policy applies (see above). 
Recall
You will fully cooperate in the event that G A L E K T I C A recalls a product. You will notify us immediately in the event that you suspect that a product has a safety defect and is subject to being recalled.
Made-to-order items
Made-to-order items are personalized and cannot be returned or exchanged. Once the order has been sent by you and confirmed by G A L E K T I C A, you will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation e-mail. Personalized items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalized nature of made-to-order products and the fact that they are produced specifically for you, they cannot be returned, refunded, or exchanged. Therefore, our Return Policy does not apply. Similarly, you do not have the right to cancel the order.
Copyright Policy 
Copyright and other intellectual property rights in any communications, ideas, or other materials submitted or offered to us by you through, on, or by this Website, including products, shall be or become our property.
 
You acknowledge and agree that the material and content contained within this Website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this Website. Accordingly, we suggest that you do not use the Website to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any trademark, design right, or copyright of the Website. 
Liability and Indemnity
G A L E K T I C A shall not be liable for any direct, special, incidental, indirect,  or consequential damages including loss of profit or loss of opportunity that result from the use of, or the inability to use, the material or products on this Website or the performance of the product purchased through the Website or the conduct of other users of this Website, even if G A L E K T I C A has been advised of the possibility of such damages, unless liability is explicitly accepted in these Terms and Conditions.
We will not be liable if for any reason the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all the Website. 
The Website may also contain links to other websites, which are not operated by 
G A L E K T I C A. When you activate any of these you will leave the G A L E K T I C A Website and we have no control over, and will accept no responsibility or liability in respect of, the material on any website which is not under our control.
You indemnify us against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.

We may terminate your use of the Website immediately if we consider that you have breached these Terms and Conditions.
Privacy 
When you use the G A L E K T I C A website we collect certain information about you such as your IP address or your contact details when you place an order. In our privacy- and cookie policy we set out how we will use personal information that we may obtain about you.
 
Jurisdiction
The Website is controlled and operated in the Netherlands. Any terms and conditions concerning the usage of this website will be governed by the laws of the Netherlands and any dispute concerning use of this website will be determined exclusively by the Dutch Courts.
General
We are free to change these Terms and Conditions at any time. If any of these Terms and Conditions are invalid or unenforceable, the remainder of these Terms and Conditions shall continue to have full force and effect.
 
We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
G A L E K T I C A reserves the right to amend, remove or vary the services and/or any page of this Website at any time and without notice.
Entire Agreement
The order acceptance that you will receive from us, together with these Terms and Conditions and our Privacy and cookie policy, constitute the entire agreement between you and GALEKTICA with respect to the use of the Website and the placement and execution of an Order.
GALEKTICA will keep this agreement on file and retain it for a certain term (having a minimum of seven years). If you have your own account you will be able to consult the agreement by logging in to that account. You may also request a copy of the agreement from us – as long as we has it on file – by contacting us via the contact details as set out below. Any waiver of any provision of the Terms and Conditions will only be effective if in writing and signed by the Director of G A L E K T I C A.
